Terms of Service

These Terms of Service ("Terms") govern your use of ClaimSwipe's website and lead generation services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Services

ClaimSwipe provides legal lead generation services, including claimant acquisition, intake screening, and lead delivery for mass tort and class action litigation. We are not a law firm and do not provide legal advice. All leads are provided for marketing purposes only.

2. Client Eligibility

Our services are available to:

• Licensed law firms and attorneys in good standing with their state bar
• Litigation finance companies and funders
• Authorized legal marketing agencies and referral networks

By engaging our services, you represent that you are authorized to practice law or conduct legal marketing in your jurisdiction and that your use of our leads complies with all applicable bar rules and regulations.

3. Lead Quality & Returns

ClaimSwipe uses a 14-point qualification process to screen claimants before delivery. We stand behind our lead quality with the following policy:

• Leads that fail your internal intake screen within 7 days of delivery are eligible for replacement or credit
• Duplicate leads (same claimant delivered twice) are always replaced at no charge
• Leads are not returnable after 7 days or if the claimant has been contacted multiple times
• Return requests must be submitted in writing with documentation of the disqualifying reason

4. Payment Terms

• Payment is due upon delivery of leads unless otherwise agreed in writing
• Starter and Professional plans are billed per qualified lead delivered
• Enterprise clients are invoiced per their custom agreement
• Overdue invoices are subject to a 1.5% monthly late fee
• ClaimSwipe reserves the right to pause campaigns for accounts with outstanding balances

5. Exclusivity

Geographic or campaign-level exclusivity is available on Professional and Enterprise plans and must be specified in a signed campaign agreement. Without a written exclusivity agreement, leads may be sold to multiple clients in the same market.

6. Compliance Obligations

All clients agree to:

• Use ClaimSwipe leads only for lawful legal marketing purposes
• Comply with all applicable federal and state laws, including TCPA, ABA Model Rules, and state bar advertising rules
• Not resell or transfer leads to third parties without prior written consent from ClaimSwipe
• Maintain the confidentiality of claimant information and use it only to evaluate and pursue legal representation

7. Intellectual Property

All content on this website, including design, copy, and data, is the property of ClaimSwipe and may not be reproduced without written permission. Lead data delivered to clients may be used for the client's internal legal marketing purposes only.

8. Limitation of Liability

ClaimSwipe's liability to any client shall not exceed the total fees paid in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages. We make no guarantees regarding case outcomes, retainer conversion rates, or settlement values.

9. Termination

Either party may terminate a campaign with 30 days written notice. ClaimSwipe may terminate immediately for breach of these Terms, non-payment, or conduct that violates applicable law or bar rules.

10. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved through binding arbitration in Miami, Florida, under AAA Commercial Arbitration Rules.

11. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance. Material changes will be communicated via email to active clients.
